HC rejects Marandi plea to defer polls

Jharkhand High Court on Friday dismissed the Interlocutory Application (IA) filed by Jharkhand Vikas Morcha chief Babulal Marandi seeking rescheduling of Rajya Sabha elections till the fate of six MlAs, who changed their sides to BJP, was decided by the Speaker, saying that the ‘balance of convenience’ was in their favour.

A bench of Justice Anand Sen also refused to interfere in the interim order passed by the Speaker on February 12, 2015 where he has identified six MlAs as members of the BJP.

“Rajya Sabha elections will be held on Saturday according to the prior schedule as the Court rejected all the prayers made by the petitioner,” said Counsel for the six defected MlAs, Rajiv Ranjan. Since a similar petition had already been rejected by the High Court on July 1, 2015, the court refused to interfere into the RS elections this time too, he added.

The Court observed that any order in this regard might have a direct impact on the decision given by the Speaker and may render the entire proceedings of the Speaker as infructuous....... which may not be the intention.

“Since a petition is already pending in the High Court which is to be heard on June 15, the court said that it will not be appropriate to interfere in this regard,” said Advocate of Jharkhand Vidhan Sabha Vinod Kumar Sahu.
