The ruling coalition may call a special session of Jharkhand Assembly to pass the 1932 land records based local policy in the State along with increased quota for Other Backward Classes, largest party in the ruling coalition, Jharkhand Mukti Morcha said on Friday. The party said that it would ensure that the crucial proposals passed in the Cabinet become laws soon in the State.
Addressing a press conference here on Friday JMM General Secretary Supriyo Bhattacharya said, “There are several technicalities involved in the process (of making the government decisions as laws) after the Cabinet decision. If the government feels that there is a need for a special Assembly session for the purpose and if the legislators decide for the same, then certainly a special session will be called. We want the situation of delusion to end at the earliest so that the decisions can take the form of laws and get published in the gazette,” said Bhattacharya.
On the issue of the office of profit case against Chief Minister Hemant Soren, Bhattacharya said that the CM had met Governor Ramesh Bais and urged him to clear confusion over the issue. The party has again asked the Governor on Friday to clear air over the matter and hand over a copy of the letter sent by the EC to the CM.
The JMM said that the advocates of CM Hemant Soren have sent a letter to the ECI, in which they have demanded a copy of the letter so that their client may take necessary action in accordance with law. The party also released the letter by Advocate Vaibhav Tomar and Malak Bhat to The Secretary, Election Commission of India.
The letter reads, “We are concerned for our Client Hemant Soren, the Respondent in the captioned Reference Case 3(G) of 2022. Pursuant to the Notice issued by the Hon'ble Commission, our Client had appeared through his Advocates by filing Reply etc. The matter was argued before the Hon'ble Commission on 08.08.2022 and 12.08.2022 pursuant to which, the orders were reserved on 12.08.2022. The parties were permitted to file their Written Submissions by 18.08.2022 in pursuance to which, we had filed the Written Submissions on 18.08.2022.”
“We have now come to learn from media reports that the Opinion of the Hon'ble Election Commission has been signed and duly tendered to the Office of His Excellency, The Governor of Jharkhand. It cannot be gainsaid that the proceedings before the Hon'ble Commission while tendering the Opinion under Article 192(2) of the Constitution of India and the Enquiry conducted therein, are judicial proceedings and the same is amply clear from Section 146 of the Representation of the People Act, 1951, which was inserted by Act 17 of 1965 w.e.f. 22.09.1965. Even the decided cases support the said contention,” it said.
“We are, therefore, addressing this communication requesting for a copy of the Opinion tendered by the Election Commission of India to the Hon'ble Governor of the State of Jharkhand (recording the outcome of the Enquiry) conducted in terms of Article 192(2) read with Section 146 of the Representation of the People Act, 1951. Kindly furnish the copy of the Opinion at the earliest to enable our Client to take necessary action in accordance with law,” said the advocates.
