Hearing on the petition filed by the police for obtaining orders for attachment of property against the former Ranchi Mayor Rama Khalkho was deferred for a day as it could not be completed on Monday.
The case will be further taken on Tuesday. The period of the notice of proclamation issued against Khalkho to surrender within a period of one month ended on Sunday.
“The petition filed by the opposite side praying not to issue orders on the petition filed by us under section 83 of CrPC seeking attachment of property against Rama Khalkho was turned down by the court on Monday. Arguments on the petition filed by us will be heard tomorrow,” said Vigilance counsel Naresh Prasad.
According to Khlkho’s counsel Afsar Hussain, they were seeking respite from the court till some order is passed by the Jharkhand High Court in this regard. Khalkho has filed anticipatory bail application (ABA) and a Criminal Miscellaneous Petition (CrMP) seeking quashing of the FIR lodged against her at lalpur Police Station.
ABA is to be heard on June 12 while CrMP will be heard on June 10 by the Jharkhand High Court. “Khalkho has prayed before the court that the orders on attachment of property should be passed after June 12 after some order is passed on ABA by the Jharkhand High Court,” said Hussain.
Hussain says a CrMP is still pending before the Jahrkhand High Court for the quashing of FIR lodged against Khlkho as no investigation was done before issuing warrant against her. “Same thing happened in the case of Sita Soren and she was given relief by the Jharkhand High Court in the abduction case lodged against her at the Argora Police Station. We have also referred some other orders passed by the Patna High Court in the similar cases,” said Hussain.
Khalkho had moved to Jharkhand High Court after the special vigilance court rejected her anticipatory bail application along with Niranjan Sharma and Sudheer Kumar Sahu as it observed that adequate evidences were found in the case diary where Prevention of Corruption Act could also be applicable.
Warrant of arrest was issued by a Ranchi court on April 09 against Khalkho who is wanted in the cash grab case after Rs 12.9 lakh was recovered from a hotel room in Ranchi allegedly meant to be used by Khalkho to influence voters ahead of the Municipal Elections. A notice of proclamation was issued against Khalkho after she could not be traced by the police.
