Centre sends 3rd letter to State on Gupta’s extension as DGP

Published on:

The central government has again sent a reminder to the state government in the case of state DGP Anurag Gupta. The central government in its reminder has again stated that the appointment of Anurag Gupta to the post of DGP is not as per the rules. The Centre has also said that the state does not have the right to make rules in the case of All India Service officers.

This is the third letter written by the Central Government in the DGP case. In this letter too, the Central Government has said that only the Central Government has the right to give extension to the officers of All India Service. The retirement date of IPS officer Anurag Gupta was 30 April 2025. The Central Government has not given him the benefit of service extension.

The Central Government has also said in its letter that the Central Government has the right to make rules for the officers of All India Service. The state government cannot make rules related to their service conditions etc.

The Central Government has also considered the rule made by the state government for the appointment of DGP as against the guidelines of the Supreme Court. Also, the rule made by the state government has not been considered correct.

The state government believes that the rule made for the appointment of DGP is correct. The state government has made the rule related to the appointment of DGP after taking the opinion of the Advocate General in the light of the Supreme Court's guidelines. Anurag Gupta has been appointed to the post of DGP under this rule.

Another aspect of this case is that Anurag Gupta is posted on the post of DGP on the orders of the state government. The case regarding making him DGP is pending in the Supreme Court. The court's decision has not come. The state government hopes that the Supreme Court will declare the rule made for the appointment of DGP as correct.

Notably, DGP Anurag Gupta was appointed to the post of DGP on February 3 following a notification issued by the state government stating that his tenure will be in accordance with Rule 10 (1) of the Selection and Appointment Rules 2025 of Director General and Inspector General of Police Jharkhand (Chief of Police Force). But, according to the central government, his retirement is on 30 April 2025.

Earlier, Anurag Gupta, who first assumed the role of in-charge DGP of Jharkhand on July 26, 2024, was removed from the post during the state assembly elections by the Election Commission of India. Following the elections, Gupta was reinstated again DGP on November 28, 2024, after the Hemant Soren government came to power with a thumping majority.
