The special CBI court of RK Chaudhary on Tuesday cancelled bail of RK Agrawal, granted by a lower court on April 9. Agrawal is one of the prime accused in the cash-for-vote scam during the Rajya Sabha elections of 2012.
“CBI had filed a criminal miscellaneous application at the special CBI court, which was allowed by the court today,” said Vikrant Sinha, counsel for RK Agrawal.
Agrawal was granted bail after he surrendered before a Ranchi court on April 9 making fresh applications for bail after he was denied anticipatory bail from the CBI court on April 5, with directions to get regular bail from the lower court.
He was granted bail on grounds of not being made accused under the Prevention of Corruption (PC) Act and the fact that Sections under which he had been charged were bailable.
Immediately, a criminal miscellaneous application was filed by the CBI on April 10 with a plea to include charges under various sections of Prevention of Corruption Act against Agarawal.
The Jharkhand High Court on Monday had raised questions on the functioning of CBI over the bail secured by Agrawal, in spite of being a prime accused. Expressing confidence in the judiciary, Agrawal had at that time had promised to appear before the CBI and the court as and when required. He had also denied of having any link with the money found from the vehicle on March 30, 2012.
Agrawal was charged of giving Rs 50 lakh to JMM legislator Sita Soren for getting her vote in the Rajya Sabha elections. The income tax department had also seized Rs 2.15 crore from an aide of Agarwal on the day of polling, after which the Rajya Sabha polls were countermanded by the Election Commission.
