In reply to the show-cause notice issued to the prosecution by a court here for failing to produce Jharkhand Mukti Morcha MlA Chamra linda before the court within 24 hours of his arrest by the Ranchi police as per the law, the police investigating officer on Monday submitted before the court that linda had been admitted to a hospital and hence it was not possible to produce him.
The court on Sunday had issued the show-cause notice to the police investigating officer for failing to produce the MlA. linda was dramatically arrested a few hours before the Rajya Sabha election on Saturday in a 2013 road blockade case in which he was allegedly involved in a scuffle and was wanted afterwards.
"As soon as the IO informed the court on Sunday that he has not been able to produce the MlA before court due to medical reasons, the court started scolding him and handed over a show-cause notice immediately in which he was asked to explain why linda was not produced within 24 hours of his arrest," said APP Avdhesh Kumar.
The IO, however, appeared again before the court with his reply on Monday citing reasons for not producing linda before the court. In his reply, the IO stated that linda had been admitted to the ICU of Orchid Hospital and any attempt to shift him out might pose serious threat to his life.
"Since the MlA's condition is not stable, doctors have advised not to disturb him as it may cause serious threat to his life. They have strictly said that he could not be moved anywhere until his condition becomes stable," stated IO in his reply. The IO also produced the doctor's certificate in the court to prove his point. He said linda will be produced soon. linda was facing arrest in a 2013 case, in which he had been allegedly involved in a scuffle at the Assembly gate in late evening hours. Soon after the incident, an FIR was lodged and arrest warrant issued and pending afterwards.
