HC directs state govt to submit scheme to accommodate medical students

Chhattisgarh High Court, Bilaspur  has directed the state government to submit a scheme to accommodate the students of Chandulal Chandrakar Medical College in another medical institute run by the state government within 10 days.

The next hearing of the case will be on October 16.

Citing shortcomings in Chandulal Chandrakar Medical College, Durg, the Medical Council of India has de-recognised the private medical college. With state government not taking action on future of students, the students Shailza Raj Jayaswal and others approached the High Court, Chhattisgarh with a petition  (WPC. No. 2888 of 2019).

During the argument over the case in the court, MCI counsel said that without a scheme to accommodate the petitioners in another Medical College run by the state government, the MCI may not be in a position to take a decision in this regard.

The counsel of petitioners had cited the recent judgement of the Supreme Court under similar circumstances where the apex court had directed the concerned state government to constitute a committee and take appropriate decision for students undergoing the MBBS course from the institution, which was subsequently de-recognised or de-registered.

Justice K. Sam Koshy in the order directed the state government to file its reply within a period of 10 days and list the matter for further hearing on October 16. The state counsel was also directed to serve the copy of reply to MCI counsel so that he can seek necessary instructions on the reply and stand of the state government.
