BJP seeks to shift ‘Sex CD’ case to other state

Published on:

A delegation of state BJP handed over a representation to Superintendent of Police, Central Bureau of Investigation, Chhattisgarh seeking to shift the hearing of ‘sex CD’ case to another state claiming that justice will be denied if the case is heard within the  state.

The letter states that CBI has submitted its interim report in the fake ‘sex CD’ case. The case is pending before the Special CBI Court, Raipur for which the hearing will soon commence.

Prakash Bajaj is the main complainant, based on his complaint the Chhattisgarh Police has registered the offence and taken action against accused.

The letter further alleges state police within two months registered FIRs in two cases against Prakash Bajaj under political pressure with the intention to harass him. He has been asked to give statement under Cr.P.C. 164 that the complaint he registered was false.

As the case has been filed against the then CPCC chief and present Chief Minister Bhupesh Baghel and his advisor Vinod Verma, there is lesser possibility of free and fair hearing in the state. Therefore, the case should be transferred to other state. State government had already made its intention clear to keep away the CBI from any probe. The letter makes a plea that as witnesses and complainant will be pressurised to weaken the case, the CBI should shift the case. Based on the representation, a transfer petition can be filed before the apex court to constitute a special court outside the state.
