The sole eyewitness in the Badaun rape and murder case failed to pass the lie detector test even as the CBI recovered a mobile phone, which he had denied having in his possession in the past.
The polygraph test report and the recovery of the mobile phone have raised doubts about the credibility of the witness’ statements made before the probe agency. During questioning by the CBI earlier, key eyewitness Nazru had denied owning any mobile phone.
Nazru underwent a polygraph test recently, and the CBI received the report on Wednesday. “The polygraph report of Nazru indicated certain inconsistencies in his statements on questions related to the case,” a CBI official said.
Contradicting his own statement before the CBI, Nazru admitted during lie detection test that he had a mobile phone, the sources said.
The mobile phone recovered from Nazru has been sent for forensic examination to ascertain whether any data had been deleted from the handset. The agency is also contacting the service providers for obtaining the call and location detail records, agency sources said.
The CBI investigation has pointed out inconsistencies in the autopsy report of the two victims.
The Uttar Pradesh police had registered the case against five persons, including two police officials, on the basis of Nazru's statements. The five accused were arrested by the police on the allegation that the two girls were raped before being murdered.
However, forensic evidence based on DNA tests conducted by the agency ruled out any sexual assault on the two victims following which the agency did not file a chargesheet against the named accused in the case. Apart from the forensic report, the five accused also cleared the lie detection test.
After re-registering the case, the CBI had taken into custody five accused, including Pappu, Awadhesh and Urvesh Yadav (brothers) and constables Chhatrapal Yadav and Sarvesh Yadav, for alleged rape and murder of the two teenage girls. They were arrested by the UP Police.
The two minor cousins were found hanging from a tree in Badaun district of Uttar Pradesh in the last week of May.
