SC orders Parsvnath to give Minister home

The Supreme Court on Friday directed realty firm Parsvnath Developers to hand over the possession of a flat booked by Minister of State Rajyavardhan Singh Rathore in the company’s Gurgaon project in 2006. Rathore paid Rs 70 lakh for the flat but he was not given possession.

A Bench of Justices Dipak Misra and Amitava Roy directed the real estate company to hand over the flat to Rathore within two days. Asking the Minister not to make any further payment, the court said it would latter decide on the interest and compensation to be paid by the builder.

Earlier in January this year, the National Consumer Disputes Redressal Commission (NCDRC) had ruled in favour of Rathore by directing Parsavnath to hand over the flat along with interest and compensation. Against this order, the company, Parsavnath Buildwell Private, limited had approached the apex court.

Rathore had booked a flat in the group’s Exotica project in Gurgaon in 2006. The builder promised to deliver the flat in three years. When Rathore did not get possession of the flat well beyond the deadline, he decided to approach the consumer court.

Parsavnath is facing a tough time. In a separate case, after the company failed to deliver flats in its Ghaziabad project to almost 70 buyers, the apex court directed the company to make a deposit of Rs 22 crore in the Supreme Court Registry and directed the sum to be disbursed to the aggrieved consumers.
