The Allahabad High Court on Friday ordered the demolition of two 40-storey towers in Sector 93-A that were illegally constructed by Supertech. A division bench comprising Justice VK Shukla and Justice Suneet Kumar said, “It has repeatedly come to our notice that builders, by joining hands with officers of the development authorities, flout every conceivable rule, including building regulations”.
The Bench ordered the demolition of the two towers — Apex and Ceyane — “within a period of four months”. The two towers are part of the Supertech Emerald Court Complex.
Meanwhile, Supertech said that it will challenge the HC order in the SC. “We are going to challenge the Allahabad High Court order in the Supreme Court. The constrution in the project is as per the approved plan, authorised and legal,” Supertech CMD RK Arora said.
The court also ordered the realtor to return the money to investors with an interest of 14 per cent.
The court found out that the construction work in the two towers, which started in 2009, were totally illegal as the builder had not procured necessary licences from concerned department before starting the construction.
RP Tandon, petitioner and former RWA president of Sector 93-A, said, "While announcing the Emerald Court Project, having 660 flats in two 11-storey towers, the builder had not mentioned about additional towers and had started the construction. On opposing the move, the realtor said that proper licences have been taken from authority, pollution department, IIT Roorkee and other departments but it was found that all licences were fake".
The builder had earlier announced 11-storey tower which was extended to 24-storey in 2011 and later to 40-storey in 2012 with the capacity of 1,500 flats. An FIR was also lodged in this regard and later they moved the court in December 2011.
