The mother-daughter duo who were gangraped on the National Highway-91 in Bulandshahr on July 29, moved the Supreme Court on Saturday seeking transfer of the case to Delhi, besides registration of FIR against UP’s Minister for Urban Development Azam Khan for his remarks and the erring policemen.
Following the brutal incident in which a group of highway robbers had waylaid the car of a Noida-based family and sexually assaulted the woman and her 14-year-old daughter after dragging them out of the vehicle which had four other occupants, Khan had made a controversial remark that there was a “political conspiracy” by the Opposition to malign the State Government.
The petition filed by advocate Kislay Pandey sought an FIR against Khan stating that his statement “substantially outrages the modesty” of the victims and their family.
It even sought action against the erring policemen who failed to act promptly on the victims’ complaint.
The petition has come close on the heels of the Allahabad High Court ordering a CBI probe into the incident and deciding to monitor the investigation.
The petition expressed dissatisfaction over the probe being conducted by the UP Police and demanded that any other “competent agency” be entrusted with the probe along with transfer of the trial from Bulandshahr to Delhi “in the interest of justice”.
The lawyer appearing for the victims has even demanded “appropriate damages” from the State, including the DGP, for infringing the victim’s right to life under the Constitution.
The petition stated that police did not respond to the helpline number 100 dialed by the victims.
