The Central Bureau of Investigation (CBI) on Thursday moved the Supreme Court challenging the acquittal of dentist couple Rajesh and Nupur Talwar in the mysterious case of their daughter Aarushi’s murder at their Noida flat in May 2008.
The CBI had faced criticism for not appealing against the acquittal order passed by the Allahabad High Court on October 12, 2017. Although the body of the domestic servant Hemraj was also found on the terrace of the same house, the acquittal of the couple led to a mystery as to who killed the two persons. Hemraj’s widow had filed an appeal against the HC order before the top court in December last year.
The agency’s appeal, likely to get listed along with the other appeal of Hemraj’s widow, pointed out mistakes in the HC order discarding statement of material witness and evidence, crucial to solve the mysterious murder. Entry of any outsider was ruled out and in such a blind murder case, circumstantial evidence becomes crucial, a fact that was ignored by the High Court, said CBI.
Interestingly, the trial court had convicted Aarushi’s parents for the murder in 2013 connecting the dots left by the CBI in its closure report. The trial court did not accept the same and directed the agency to proceed with the investigation leading to conviction in the case, with the dentist couple being sentenced to life imprisonment.
