Supreme Court dismisses PIL seeking NEET-PG 2026 re-test, imposes cost on petitioner and advocate
New Delhi: The Supreme Court on Thursday dismissed a PIL seeking a re-conduct of the NEET-PG 2026 exam, pulling up the petitioner and the advocate and imposing a cost for filing the plea.
A bench of Justices PS Narasimha and Alok Aradhe dismissed the petition with a cost of Rs 25,000, and said it would flag the matter to the Bar Council of India over what it called misuse of the writ jurisdiction by the advocate.
The petitioner sought re-examination for all NEET-PG candidates, alleging the exam violated a May 2025 Supreme Court order that mandated the test be conducted in a single shift.
Counsel for NBEMS told the court that of 1,111 examination centres across India, disruption occurred at only two centres in Jaipur due to a power failure. The counsel said the petitioners were from Noida and Punjab and were not among the students affected.
Justice Aradhe asked whether the petitioners intended to appear for the exam themselves; counsel said no. Justice Narasimha remarked that the advocate had become a "full-time PIL litigant," questioning why petitions were being filed wherever exams were conducted and suggesting the lawyer was soliciting cases from aspirants on social media.
The bench said it would ask the Bar Council of India to take serious action against the advocate.
