Matthew Van Dyke moves Delhi court for bail in terror conspiracy case
New Delhi, September 17: A Delhi court on Thursday sought the National Investigation Agency’s response to the bail plea filed by US national Matthew Aaron Van Dyke, who was arrested in a case involving an alleged terror conspiracy and links with ethnic armed groups.
Special Judge Prashant Sharma issued notice to the NIA and directed the agency to file its response by September 18, according to court sources. Van Dyke has sought bail after the NIA’s recent chargesheet against him and six Ukrainian nationals did not invoke provisions of the Unlawful Activities (Prevention) Act (UAPA).
The NIA had earlier filed a chargesheet under Sections 21 and 23 of the Immigration and Foreigners Act, relating to alleged illegal entry, stay and movement in India. The agency said further investigation was required to establish the complete facts regarding possible offences under the UAPA.
The seven foreign nationals were initially investigated in connection with allegations of assisting ethnic armed groups in India and Myanmar and providing drone-related training. The NIA has maintained that the broader UAPA investigation has not been closed and that further evidence could lead to additional chargesheets.
Van Dyke was arrested in March 2026, while the six Ukrainian nationals were also taken into custody in connection with the case.
