Suspended IPS officer Amitabh Thakur moved the lucknow bench of Central Administrative Tribunal challenging his suspension order of July 13, 2015 and filed a petition on Friday.
Thakur challenged his suspension order quoting Rule 3(8) of the All India Services Discipline and Appeal Rules which states that every suspension order must be reviewed and it should be extended within 90 days of the suspension. The rule also says that if such review is not done, then the suspension order stands automatically revoked.
The IG rank officer said that his suspension was extended for 180 days through an order dated December 10, 2015 but only after 150 days had elapsed as his initial suspension order was issued in July, 2015. The delay has been condoned by the UP government at its own end on February 12, 2016. Calling these orders illegal, Thakur prayed to the CAT that he be reinstated from the 91st day of his suspension.
Meanwhile, Thakur also complained to the National Human Rights Commission (NHRC) about being intercepted at the outer gate of CM's official 5, KD Marg residence by cops and preventing him staging a dharna on Thursday. In the plaint, the IPS officer has submitted that he had gone to CM's residence to express his anguish drawing parallels with the reinstatement of lucknow DIG D K Chaudhary within 15 days of being suspended. He said that a police team led by SO Gautampalli S K Katiyar stopped him at the gate.
Thakur said that when he asked the cop about the reason of his action, the SO cited 144 Cr PC being in force for being a high security zone. He said that he was all alone and had only a mat and a laptop with him. Besides, others were being allowed to visit the scene. Treming it a denial of his Constitutional rights and illegal restraint, Thakur requested the Commission to enquire the matter at its end and not forward it to the UP government. He sought criminal and administrative action against delinquent policemen and also sought proper compensation.
