A petition has been moved before Governor Ram Naik seeking removal of Bahraich MlA, Waqar Ahmad Shah for being in coma for long and hence being disqualified under Article 191 of the Constitution. Social activist Dr Nutan Thakur, who presented the petition here on Tuesday morning claimed that when a person is in coma, his capabilities of thinking and rational decision-making gets completely stopped and hence he comes in the category of person with unsound mind as defined in Article 191.
It says that though Shah has been a successful and veteran politician and his slipping into coma was most unfortunate but if it actually happened and he is in coma for 2 years now, because of which he had to be removed from minister-ship as well. In such circumstances, the people of this constituency cannot be deprived of their constitutional right of having a public representative in State assembly. Hence she had requested the Governor to use this authority under Article 192 of constitution to disqualify Shah, thereby making way for fresh elections there.
