Governor Ram Naik has sent the much talked about Depositor’s Interest Protection Bill, which was earlier passed by the UP legislature, for the consent of President saying several clauses of the Bill needed the latter’s consent.

A communication from Raj Bhawan said in lucknow on Tuesday that the Governor had sent the Bill for the consent of President Pranab Mukherjee as per the Constitution of India. The Bill Depositor’s Intrest Protection Bill, 2016, was passed by the legislative Assembly on March 8 and the next day it was approved by the legislative Council. On March 16, the Bill was sent by Akhilesh Government to Raj Bhawan for the Governor’s assent.

“The punishment for the defaulters suggested in the Bill is at variance from the Criminal Procedure Code, which is part of seventh schedule of the Indian Constitution. In this case, the sections 254 and 254 (2) of the Constitution says that assent from President is a must because CrPC is a Central Act. In this scenario, the Bill has been sent for President’s approval,” a spokesman of Raj Bhawan said in a written statement.

Recently, the Governor came under fire for not giving his assent to a Bill related to urban local bodies. The UP Nagar Nigam (Amendment) Bill was passed by the UP Assembly on March 26, 2015 and since then it has been with the Governor. The Bill empowers the state government to remove Mayors besides curtailing the power of local bodies. Urban Development minister, Azam Khan had questioned the Raj Bhawan for delaying in giving assent to a Bill passed by the UP Assembly. Taking note of the incident, the Governor had asked for unedited tape of the House proceedings which the state government submitted last week to the Raj Bhawan.
