local court's order , re-investigate the matter of Amit Shah

Published on:

The cops of the Muzaffarnagar police concealed the information about the local court’s order of re-investigation into the case registered against BJP president, Amit Shah, for an alleged hate speech he made in April 4 during the lok Sabha campaign.

The local court observed that the charge-sheet filed against Shah by the Muzaffarnagar police on July 30 last is two weak to trail the BJP leader so the court turned it down on Wednesday,  when it came up for hearing with the direction to re-investigate the matter and collect more proof before filing the charge-sheet. Interesingly, on Wednesday evening, when the Muzaffarnagar police was contacted in this regard, they just confirmed about filing of the charge-sheet that too more than a month back but not disclosed about the court’s order which already rejected it till then.

Sources said that the ADJ(3) Manoj Kumar Siddhu, during hearing of the CS (Charge Sheet No-259/14) filed by the police on July 30 last, was surprised that the BJP president was just charge-sheeted for Section 123(3) of Representation of People Act (making an appeal to vote on the grounds of religion amounting to corrupt practice), and 188 of IPC but they withdraw the charges against Shah, who was also accused under Section 153A (promoting enmity between different groups on grounds of religion, race, place of birth, etc.), 295A (deliberate and malicious acts, intended to outrage religious feelings of any class) and 505 (false statement, rumour, etc, circulated with intent to cause mutiny or offence against the public peace) and Section 133 of Representation of People Act.

Sources further said that the court also observed that not only some major Sections has been removed by the local police from the CS, but the evidences for other allegations is also very weak and would ultimately help the accused to go scot free in the end. Following the negligent approach made by the Muzaffarnagar police in collecting the evidence against Shah, the court finally sent back the CS asking to open the investigation, collect more evidences and than filed fresh charge-sheet.

It may be mentioned that in what seems to be an effort to polarise the on-going by-polls, a charge-sheet filed against Bharatiya Janta Party (BJP), President Amit Shah, in connection with `hate speech’ more than a month back suddenly hit media hide-lines on Wednesday.

While BJP came out in support of Shah, questioning the timing of charge-sheet, senior officers in Muzaffarnagar, blamed media for unnecessary raising the issue now as they filed CS in a local court. The charge sheet was filed against 49-year-old Shah in a court here for allegedly seeking votes on the grounds of religion, race, caste and community during campaigning for the Party on April 4, earlier this year in Muzaffarnagar.
