HC asks govt to make amendments in mining rules

Published on:

The lucknow bench of the Allahabad High Court directed  the State government to make suitable amendments in the  mining rules, after hearing a PIl challenging the  suspension of Gautambuddha Nagar Sub-Divisional

Magistrate (SDM) Durga Shakti Nagpal.  Bulbul Godiyal, Additional Advocate General, told the  Court during hearing here on Friday that presently mining  lease is granted even before the sanction of environmental  clearance from the Centre and this clearance is obtained  after grant of lease. She added that the state government  was in the process of amending mining rules.

A Bench comprising Chief Justice Shiva Kirti Singh and  Justice D K Upadhyaya seemed completely dissatisfied  with the state government's present arrangement and  directed that new rules should be so framed that  environmental clearance is obtained before grant of lease  so that the possibility of mining without gaining clearance  gets eliminated.
