Social activists Nutan Thakur claimed that the Right to Information Act (RTI) was promulgated to bring transparency in governance but director general of police (DGP) Office, seems to be above this Act. She alleged that the DGP office comes with newer methods to deny information sought under RTI.Nutan claimed that her husband Amitabh Thakur, who is an IPS officer and also a
RTI activist had sought certain information as regards his poetry collection Atmadarsh. She said that inspector general (karmik)at DGP office, Tanuja Srivastava, refused to provide the information saying that it will be provided only after the State government has taken decision on the matter.
Nutan Thakur claimed that Chief Information Commissioner Ranjit Singh Pankaj had found this refusal completely improper and imposed a fine of Rs. 25,000 under section 20 of the Act. However, now Tanuja Srivastava has presented a penalty-waiver application before the Commission where she has said that the information could not be provided because "the matter was administrative in nature on which decision was to be taken by the Government" while RTI Act provides no such reasons for withholding information. She called Tanuja’s move as blatant disregard of the RTI Act and has called for administrative action against the recalcitrant officer.
