local court in Badaun will deliver judgement on the closure report by the Central Bureau of Investigation(CBI) on Tuesday in the in the much publicised death of two teenage cousins in Katra village Badaun in May last even after the agency failed to submit the evidences before the court on Monday. However counsel of the victims family and the CBI completed their arguments in the matter and the Additional district judge(POSCO Act), Anil Kumar, has reserved his judgement till Tuesday.  Kokab Hasan, the lawyer of the victim’s family alleged that

even after three dates, the CBI failed to produce the evidences by which they have moved the closure report. He said that CBI is  ‘habitual’ in doing this by not submitting any evidences or witnesses in closing the case. But CBI counsel Kumar Rajat talking to media outside the court said that they have presented their views before the court, who will deliver its verdict on Tuesday. ‘ We have all the evidences and will submit it as per the court’s directive,’ he said while adding that CBI always submits closure report on the basis of evidences.

Rajat said that the family members are too accused under section 182 and 211 of the IPC as per the charge-sheet filed by the CBI in the case. Both the cases are of non-cognizance nature. While 182 deals with lodging fake FIR while 211 is concerned with hiding the facts.  He further said that from day one, the family members tried to confuse the CBI by giving contradictory statements.

CBI has filed a closure report in the case claiming that the girls had committed suicide. The agency filed the closure report of 34 page without giving any evidence on December 12. Earlier  has directed the CBI as well as the family members of the girls to provide evidences and other relevant documents in the court on January 16 and then on February 2.  The agency filed its report saying there was no forensic or circumstantial evidence suggesting rape and murder as alleged in the FIR registered by Uttar Pradesh Police after the girls’ bodies were found hanging from a tree in May.

The CBI said the two girls had committed suicide fearing retribution as the elder girl’s affair with a local boy from a different caste had come to light.  The final report mentions questionable actions of the fathers of the girls, an uncle and main witness Nazru, also a distant relative, leaving it to the court to take further action, sources said.  The bodies of the two cousins, both around 14 years, were found hanging in an orchard onMay 28. The girls’ families had alleged that they were kidnapped and murdered by five youths from the village.

The incident sparked an outcry in the country and abroad with questions being raised over the law and order situation. Even United Nations secretary general Ban Ki-moon had expressed concern.   The CBI said there was no evidence of rape or murder as there was no sign of struggle on their clothes and bodies. The agency said forensic analysis also revealed that there was no male DNA or sperm on their bodies.

The agency closed the investigation after dropping charges against five persons — Pappu, Awadhesh and Urvesh Yadav (brothers) and constables Chhatrapal Yadav and Sarvesh Yadav — named as prime accused by the state police for the alleged rape and murder of the girls.  Both policemen were even terminated by the government.
