Army man knocks SIC door for huge ancestral property

To get his name entered into the record of the thesil for the huge ancestral property owned by him, a retired army man had knocked the door of the State Information Commissioner.

Surprisingly the hapless retired central government employee had decided to take advantage of Right to Information (RTI) Act just to get compliance of court orders which was already delivered in his favour more than two decades back. Now after the SIC issued notices and summoned the officials concerned, they informed that the land was already transferred into the above retired army man’s name but in the thesil `record’ the same will be done in the coming July this year.

Giving details of the case, SIC Hafiz Usman said here on Tuesday afternoon that one lt Col (Retd) AK Saxena, had filed an appeal in his court, informing that his ancestors which included his father Radhey Shyam and uncle Saloney Shyam had huge lands at Bainjni Muhal in Chandausi. Saxena claimed that in 1989, his father learnt that one Dinesh Kumar Saxena alias Kalia, having dubious character got his name mutated in the Thesil records for forging two `Wills’ of his father Radhey Shyam and under Saloney Shyam, dating back to 1973.

Saxena claimed that this fraud was challenged by his father and was finally also set aside by the additional commissioner Judicial, in revision suit No 15/94 dated February 20, 1995. The orders had to be entered at Page No 74 of the then Registrar Kanoongo Chandausi. He alleged that still the name of Dinesh Kumar Saxena has not been removed from any of the `Khewat/Khatauni’ of his lands. He said that name of his father and uncle was never mutated back in the tehsil records despite of his all efforts to get the court orders complied with.

Saxena further claimed in his appeal that his father also challenged `Sale Deed’ executed by Dinesh Kumar as the `bogus heir’ of his father and uncle which was subsequently reverted. Saxena said that his father handed over an application to execute criminal case against Dinesh as he had forged his `Will’ and even filed a forged `Sale Deed’ but the local officials in Moradabad still took no cognizance. He said that his father died in a road accident but he suspected that the `killing’ was masterminded by Dinesh who till then already get life threats to his father. Alleging that the tehsil as well as local police was hand-in-gloves with Dinesh Kumar Saxena, the complainant said that he tried to get his name through RTI Act but when he failed to get any information, he filed an appeal.

Usman said that taking serious cognizance of the matter, he summoned the Thesildar of Sambhal and directed him to appear with all the records. He said that now after his intervention, the thesil officials informed him that the land was already transferred in AK Saxena’s name as per court orders but the name in the page 74 of the Registrar Kanoongo can not be entered as the exercise will be done in July 2016 so when the same will be taken in coming July, they would also entered AK Saxena’s name. Usman said that he directed the officials to do the same or be ready to face stern action as well as criminal proceedings for tempering with the `thesil records’
