Supporting ban on Triple Talaq system, the All India Shia Personal law Board (AISPlB) has decided to file petition in Supreme saying such divorce system does not exist in the Shia sect.

“In the Sairah bano case of Supreme court, it has been demanded to ban the triple talaq system in the country. The board has decided to present Islamic laws of Shia Muslim Sect where this divorce system does not exist,” said Maulana Yasoob Abbas, Spokesperson AISPlB after Board’s executive committee meeting at Sultanul Madaris on Thursday.

A long debate had been taking place in the country over Triple Talaq. The All India Muslim Personal law Board (AIMPlB) had been demanding that divorce is a Muslim personal law issue and governments or courts should not intervene in the Islamic laws. While on the other hand, the women organization has opposed the triple talaq system and demanded to ban it in the country.

The AISPlB executive council opposed the triple talaq system as according to them, it was against the humanity and the practices of any religion cannot go beyond it. “The triple talaq system should be banned as it doesn’t gives much rights to the women. If a man gives divorce to his wife, after a month he should be asked about his decision as he could have been regretting on his decision. It was said that this tradition was started in the reign of second caliph but it was stopped in the period of fourth Islamic Caliph then how come can it be a part of Islamic laws,” claimed MK Sherwani, member AISPlB.

Senior Supreme Court lawyer, Qaiser Kazim who would be present AISPlB’s view on divorce in the court, also demanded to ban the triple talaq system.

Praising the decision of AISPlB, Delhi based Human Right Activist Shabnam Khan had written a letter to the board. “The Modern Nikahnama prepared by the board is the best solution to the Triple Talaq problem. This should be implemented immediately which would give relief to Muslim women of the country,” she said in the letter.

In the AISPlB’s Nikahnama, the women had been given right to divorce. There was a provision too, that if wife’s legitimate wishes are not fulfilled by the husband in two year she can take divorce from him. The Nikahnama also restricts Husband from demanding dowry after the marriage. “We have give a copy of Nikahnama to the members of AIMPlB too for review and implementation to tackle the issue of Triple Talaq. It is available in Hindi and English language so that bride and groom can read the conditions of marriage properly,” said Maulana Yasoob Abbas.
