AIMPlB to chalk out its future course of action on triple talaq ruling

The All India muslim personal law board (AIMPlB) has convened the meeting of its executive committee at Bhopal on September 10 to chalk out its future course of action with regard to the Supreme Court’s verdict on triple talaq.

The board has welcomed the verdict saying ``the apex court has upheld the existence of the fundamental rights of the muslims as enshrined in the constitution’’.   The board claimed that the SC has also not held the practice of the triple talaq as ultra virus of the constitution. The board has however opposed the apex courts direction to the government for enacting legislation for regulating the practice of marriage and divorce for the Muslims.

``If the Central governments decides to bring a new legislation for divorce then it would be the violation of the muslim personal law and the fundamental rights of the muslims’’, said  Zafaryaab Jilani, member of the executive committee of the board  here on Tuesday.

``The SC verdict has been referred to the legal committee of the board and this committee after studying the courts verdict will submit its report to the executive committee at Bhopal. The agenda of the meeting has been issued’’, said Zafaryaab Jilani, member of the executive committee of the board here on Tuesday.

Jilani said the courts verdict has strengthened the secularism, democracy and the rule of law and has enhanced the respect for the judiciary.

AIMPlB, one of the parties in the triple Talaq issue in the Supreme Court has welcomed the judgment saying that the court has upheld the fundamental rights of the Muslims.  He said the board is already running a campaign against the practice of triple talaq and the campaign will be intensified.

``There is a proposal to include in Nikaahnama that the practice of triple talaq is a crime against religion and the Kazi (cleric) should explicitly inform the bride and the groom about this. This proposal will be discussed during the Bhopal meeting’’, said Jilani.  Jilani said that besides triple talaq , other issues will also be taken up in the meeting. He said that the hearing on the Babri mosque case is also on the agenda of the Bhopal meeting.

The Board, which is an NGO, had opposed the PIl in the Supreme Court seeking the ban on the practice of triple talaq. In April this year, it issued an eight-point code of conduct to prevent the “misuse” of the practice and other Islamic laws (Shariah) to pre-empt an adverse verdict from the apex court.

It had also launched a signature campaign seeking non-interference in Muslim personal law. In the strongest ever censure against the practice, the Board had also called for “social boycott” of the person who divorces his wife by pronouncing triple talaq in one sitting.
