Opposing Supreme Court’s decision which allows adoption by Muslims, South Asia’s leading Islamic Seminary, Darul Uloom Deoband clarifies that the decision is against shariah laws.
"It has been clearly mentioned in the Shariah law that Muslims are not allowed to adopt any child. Firstly, it would be non-Mehram (no direct blood relation) and secondly, the adopted child will not have any share in inheritance," said Rector Darul Uloom Deoband, Maulana Mufti Abul Qasim Nomani.
He said when the constitution of India has a provision of Freedom to practice religion then why such decision was taken which directly opposes the divine laws. The court should review the decision taking reference of the Shariah laws.
"The Muslim organisations should come forward in the case and file a review petition on this ruling of the Supreme Court allowing adoption to Muslims," he added. Public Relation Officer (PRO) Deoband, Maulana Ashraf Usmani said this issue of adoption of child is a well known issue and many at times fatwas had been issued in this regard by the seminary. There were Fatwas where it was clearly stated that as per Shariah laws Muslims cannot adopt child. He said through such decisions the governments are clearing the way for Uniform Civil Code which will infringe Muslim Personal laws directly.
