Social activist Nutan Thakur demanded removal of Minister for Parliamentary Affair and Urban Development, Azam Khan, who is also Chairman of Uttar Pradesh Jal Nigam from his post.
She alleged that Samajwadi Party leader had violated the laid norms hence he had no right to continue in the office. She filed a Public Interest litigation (PIl) in the Allahabad High Court, lucknow Bench praying for removal of Azam Khan from his post.
As per the petition, social activist Nutan Thakur claimed that UP Jal Nigam is governed by the Uttar Pradesh Water Supply and Sewerage Act 1975. Section 7(3) of this Act says that the office of the Chairman shall not be deemed to be an office of profit and he shall have no authority on managerial functions of the Nigam. The managerial functions of the Nigam shall be performed by the Managing Director and other officer.
She alleged that despite of this, an Office Memorandum was passed on 28 August 2012 under signature of Azam Khan which said that the managerial functions shall be done by the Chairman. Azam Khan is currently undertaking all administrative and financial works in Jal Nigam against the prescribed Act. In light of the above fact, Nutan Thakur has prayed before the court to get Azam Khan removed as Chairman and quashing of the above illegal order.
