Practical approach to removing judges

Published on:

This refers to the report, “Mahabharat in judiciary” (March 11). Of course, the counter move by Calcutta High Court judge CS Karnan is irrelevant because he has already been stripped of judicial work. All this has damaged the image of the higher judiciary badly. It is high time that a procedure be put in place to remove judges of higher courts.

A permanent national judicial panel should be formed with retired Supreme Court judges as the member-nominees of the Prime Minister, the Opposition leader, the Chief Justice of India and the Bar Council of India, with the Chief Vigilance Commissioner as its ex-officio Secretary. This commission should be empowered to probe complaints against judges of higher courts and make binding recommendations for the President to remove guilty judges.

It is also time that the appointment process of judges be made public to effectively check appointment of controversial persons in higher judiciary.
