This refers to the article, “The Curious Case of Teesta's Bail Petition” (March 25) by Rajesh Singh. It is a jaw-dropping example of the judges allowing de facto bail without attendant conditions and responsibility to Ms Teesta Setalvad. Given the reasoning of the judges, no accused, irrespective of joining the investigation or not, should be arrested without reference to a larger Bench of the Supreme Court! Remember, a previous Bench hearing Ms Setalvad’s petition had made it known that she would not be treated lightly on the serious charge of embezzlement of funds.
On the other hand, we have had a case of a teenager who spent four days in prison for using supposedly offensive language on social media against a powerful Minister of Uttar Pradesh. The law, based on which the arrest was made, has been since declared invalid. What astonishes a layman like me, is: What made the highest court expose itself as over-stretched in the case involving Ms SetalvadIJ
