Sir — Of late, we find judges of the High Courts and also the Supreme Court recusing themselves from cases before them, most of the time when the final judgment has to be delivered, without assigning any reason whatsoever for doing so. Most of the time, we find this happens in sensitive cases involving senior political leaders. Judges to the High Courts and apex court are appointed after careful analysis of their past performance in the judiciary, their credibility and honesty.
It is also expected that they go through the cases presented before them with absolute care and deliver judgements in an impartial manner within the framework of laws and Indian Constitution. This being the case, judges recusing themselves from cases before them and seeking transfer of them to other peer judges/benches is unjustified. This is more so when we find no conflict of interest in those cases handled by those judges. Does it mean that they are scared of such political bigwigs or don’t want to antagonise the politicians and others with muscle and money powerIJ
