This refers to the report, “SC scraps NJAC, revives collegium” (October 17). By striking down the Government’s ill-conceived National Judicial Appointments Commission Act as unconstitutional, the Supreme Court has upheld the Constitution-makers’ concern to protect the independence of judiciary, by not allowing the high degree of balance envisaged in the Constitution between lawmakers and law protectors to tilt in favour of the former.
Since Emergency, successive Governments have been keen on having a ‘committed’ judiciary. However, this judgement will be welcomed by those, who know the value of an independent judiciary.
