Huge case backlogs are a major concern for all

This refers to the editorial, “Overriding litigations” (June 23). The pendency of cases will only go up and the question of cases coming down in number cannot be expected even in dreams. The Government should act responsibly by not adding to the fleet of litigations in courts. It is not only the money that always matters in courts cases. The reason for dragging the cases for an indefinite length of time can be attributed to irrelevant points being brought to the court, prompting the lawyers of both the sides to enter into needless arguments. Much of the time is lost in concentrating on points not closely connected with the case.

In this, the core issue on which the litigation has come up, will be forgotten. Adjournment plays a negative role in the justice delivery system. The practice of too frequent adjournments has entrenched itself in the present justice delivery system. It is appalling that are over 60,000 cases in the Supreme Court and 40 lakh in various High Courts and 2.7 crore cases in the subordinate courts are pending. Besides the judiciary being non-functional during summer vacations, the court work comes to a standstill when judges are on training. It so happens that when a case is listed for hearing, the latter will not take place at the given time. It is a cruel joke on the litigant. If any one asks what the progress in the case listed for today is, it can be easily said, Gone for next date of hearing’.
