Sir — This refers to the article, “Collegium system gave us this judge” (May16) by Sandhya Jain. Every right-thinking person will countenance the writer’s view that many a judicial problem, caused due to confrontation between the executive, the legislature and the judiciary, flows from the ambiguous division of powers among these institutions. The case in question of violation of the rules against Calcutta High Court judge, Justice CS Karnan, is an outcome thereof.
There’s no denying that the ‘might is right’ motto has always found relevance in every proposition — be it the monarchy, autocracy, bureaucracy or theocracy. The buck is always passed on to the weakest in any hierarchy.
