Sir — This refers to the report, “‘NJAC could undermine judicial independence’” (October 24). An ideal process of appointment of judges to the higher judiciary must be rooted in the text of the Constitution and law enacted by Parliament, and not in judicial interpretation alone.
The 22-year old collegium system seems to be the darling of the apex court because, through it, the court has given to itself almost all powers in matters of appointment to the higher judiciary.
The striking down of the National Judicial Appointments Commission Act, merely because the executive too is given a participatory role in it, reflects an unhealthy desire on the part of the apex court to usurp power and keep it to itself. We need to have supremacy of the Constitution, but not the tyranny of the judiciary.
