This refers to the editorial, “The failed earthquake” (January 13). Refusing to take certain entries in Birla-Sahara diaries as evidence for ordering a probe against Prime Minister Narendra Modi and others, the Supreme Court in its order said, “In view of the materials placed on record and peculiarity of the facts and circumstances, no case is made out on merit to direct investigation against various political functionaries, officers etc. The interim applications are found to be merit-less and are dismissed.”
It may be recalled that Delhi Chief Minister Arvind Kejriwal had called for a special one-day session of Delhi Assembly, to claim on the basis of these diaries, that the Prime Minister was corrupt. On the other hand, Congress vice president Rahul Gandhi had claimed that he had evidence which would induce an earthquake if disclosed. The apex court’s salutary remark that the process of law can be misused and that no democracy can function if investigation is set in motion against high constitutional functionaries without cogent material, is a blow to the likes of Kejriwal and Gandhi.
