Apex court strikes a fine balance on Uttarakhand

This refers to the editorial, “The Uttarakhand saga” (April 23). The Supreme Court's decision to stay the Uttarakhand High Court's order was appropriate and reasonable. The order must have cut the unduly ecstatic Congress party to size. The apex court’s decision to take a call on the correctness of the floor test on April 29, as directed by the High Court, should set to rest all wagging tongues. However, the High Court has strangely, failed to release the signed copy of its judgement on such an important issue involving President's Rule. The apex court's observation over the High Court's oral orders should set in a fresh precedent for all higher courts.

By observing that President's Rule cannot be revoked “just like that”, the highest court of the land has hinted that there were several important points in the case which needed elaborate hearing. It would be best to hand over the case to a Constitution bench because, after the SR Bommai verdict of 1989, much water has flowed down the bridge since then.
