Anti-constitutional

Sir — This refers to the editorial, “It’s dangerous politics” (December 6). Besides seeking to demolish the federal structure of India, the communal violence Bill violates the Constitution of India, which says that Parliament cannot enact laws which discriminate between people on the basis of religion.

The Fundamental Rights entitle the citizen the “right to equality, including equality before law, prohibition of discrimination on grounds of religion, race, caste, sex or place of birth, and equality of opportunity in matters of employment, abolition of untouchability and abolition of titles”.

The provisions of the proposed Act can be challenged as being ultra vires of the Constitution. The Government may have diluted certain provisions following opposition from political parties, but the UPA’s intent is still suspect.
