Sir — This refers to the article, “SC collegium: Judicial oligarchy crumbles” (September 6) by Sandhya Jain. The writer has done well to highlight certain issues concerning the powers of the judiciary.
When we were young, we were taught that the function of the judiciary was to see whether the Government at the helm was functioning according to various Articles of the Constitution.
However, it was not expected that the judiciary would come into picture, to decide administrative matters like the transport system and cleaning of rivers.
The same principle applies to the process of selection of judges. It is for the people of India to decide what system is to be followed in this matter and whether they would allow any institution to have a purely in-house selection system without having an outside expert on the selection Board.
In view of the controversy that is raising its head, it seems necessary for Parliament, which is the sovereign representative of the people of the country, to take stock of the situation and make the will of the people in this matter clear in the Constitution without any ambiguity.
