The trial against the two Italian marines wanted for the murder of Indian fishermen on high seas would be held up till December 2018, when the order by an international tribunal on the jurisdiction of India to try the two marines is expected.
This statement was made by Solicitor-General Ranjeet Kumar appearing for Centre before a Bench of Justices AR Dave, Kurian Joseph and Amitava Roy. With the trial expected to take place only after the tribunal’s decision, the Bench decided to allow one of the marines, Massimiliano latorre, to extend his stay in Spain and undertake to return by September 30 this year.
Senior advocate Soli Sorabjee who appeared for the Italian Government pleaded that no purpose will be solved if latorre comes to India since trial is stayed till December 2018. But the Bench said, “We will think of extending time then. let us know by that date what is happening before the tribunal.”
Meanwhile, court was informed that the second marine, Salvatore Girone has moved an application before the International Tribunal hearing Italy’s dispute with India to return to Spain.
