In what is being termed by the political Opposition in Bengal as a “shameless desperation” of the ruling Trinamool Congress “to perpetrate criminalisation of politics”, the State Government has decided to move the Division Bench of Calcutta High Court against a single bench order to file FIR against actor-MP Tapas Pal and transfer the case to the CID to conduct a court-monitored investigation.
Pal who had in public speeches on June 14 threatened the Opposition CPI(M) workers with murder and rape went scott free after his party pardoned him in lieu of a reported ‘unconditional apology’ and the Government refused to proceed against him saying the hate speeches did not make out any cognisable offence.
State law Minsiter Chandriman Bhattacharya on Tuesday said that “a decision has been taken to file an appeal” against the Monday order passed by Justice Dipankar Dutta who had cast caustic remarks on the State’s deteriorating law and order and the role of the police while directing the DGP to convert the complaint made by petitioner Biplan Chowdhury in this regard into an FIR and transfer the case to the DIG CID within 72 hours of the order being uploaded in the Court website.
Pal’s lawyer Rajdeep Majumdar also said that his client would prefer an appeal before the Divisional Bench. “We will also prefer an appeal against the order” he said.
Pal a Trinamool MP from Krishnagore had in a series of public meetings in Nakashipara in his constituency threatened the CPI(M) activists with murder and rape before tendering an ‘unconditional aplogy’ to his party leadership which in turn considered the matter a “closed chapter” triggering a massive nationwide uproar seeking action against the erring MP.
