A former district judge of Madhya Pradesh who accused a sitting judge of MP High Court of sexual harassment has approached the Supreme Court challenging the decision passed by the Supreme Court giving a clean chit to the accused judge without conducting a proper enquiry into her allegations.
Challenging the decision of the then Chief Justice of India Hl Dattu taken on July 19, 2015, the lady judge who had resigned as Additional District and Sessions Judge of Gwalior last year pointed out several loopholes in the report by a three-judge panel submitted to CJI on July 2, 2015. This report had concluded that the accused HC judge approached the panel with unclean hands and gave contradictory statements full of falsehood yet concluded that evidence against him was insufficient. This formed the basis for CJI to close the case against the judge.
“Having come to the aforesaid conclusion on fact and having regard to the nature of sexual offences, the Committee ought not to have come to a conclusion that there is insufficient evidence of the charges of sexual harassment,” the lady judge said in her petition filed by advocate Devdutt Kamat. The alleged sexual misdemeanor had occurred at various occasions since she joined service in October 2012 and was victimised by the HC judge for not giving in to his demands.
