SC to probe disproportionate assets case of Balakrishnan

The Supreme Court on Tuesday indicated that it will probe the disproportionate sources of income of former Chief Justice of India KG Balakrishnan even as it turned down the plea of an NGO to examine the alleged “benami” transactions of his son, daughters and son-in-laws in this connection.

The Bench of Justices Dipak Misra and PC Pant, dealing with the PIl filed by NGO Common Cause, sought the assistance of the Attorney General Mukul Rohatgi on the next date of hearing fixed for November 15, indicating that the focus will be on alleged Income tax violations.

“It is the duty of the Income Tax officer to find out the source of income. That action has not been taken… let Attorney General appear and assist us,” said the Bench.

As per the NGO’s counsel Prashant Bhushan, over 21 properties were acquired by Balakrishnan’s family and a report filed by the Income Tax agency showed how several queries of the department on “sources of income” were not replied to the satisfaction of the investigators.
