The Supreme Court on Monday set out to examine whether an elected representative is required to disclose complete information of his criminal antecedents in his nomination paper or only those cases which are heinous in nature.
A petition brought to Court by lok Sabha MP from Sasaram Chhedi Paswan raised this question after the BJP parliamentarian's election in 2014 was set aside by the Patna High Court recently after an elector complained that Paswan failed to make complete disclosure of criminal cases pending against him prior to the elections. The apex bench of Justices Ranjan Gogoi and PC Pant ordered stay of the Patna HC decision and said, "It's a serious issue. We have to see whether every offence or only serious offences are covered under our earlier judgment (mandating full disclosure of criminal antecedents)."
