The Supreme Court will hear a petition next week against Prime Minister Narendra Modi calling in question an affidavit filed by him in 2012 Assembly polls where he did not disclose the name of his spouse.
The petitioner Nishant Deshdipak Varma filed the appeal in apex court after his complaint was dismissed by the Gujarat High Court on the ground of delay.
Varma through his lawyer Prashant Bhushan found fault with the HC order to dismiss the petition at the threshold without noting that the period of limitation would begin from the date when he obtained knowledge of the commission of offence.
According to Varma his complaint against the PM filed before a Gujarat court on April 11, 2014 was valid as it was filed soon after Modi disclosed the name of his spouse in the election affidavit filed by him on April 9, 2014 while filing nomination during the lok Sabha polls.
Varma alleged that when Modi contested Gujarat assembly polls from Maninagar in 2012, he left the column of spouse blank, which amounted to concealing information under Section 125A(iii) of Representation of Peoples Act 1951.
