The Supreme Court on Wednesday refused to stay the arrest of Calcutta High Court judge CS Karnan asking him to approach the special bench headed by Chief Justice of India which ordered his immediate arrest on May 9.
Evading arrest since then, Justice Karnan through advocate Mathews J Nedumpara said that being a judge he was victimized as his application to stay the sentence of six months imprisonment against him is not being heard.
When the matter was mentioned before the Vacation bench of Justices Ashok Bhushan and Deepak Gupta, the judges advised Nedumpara to approach the bench that passed the order. When the counsel asked the reason for punishing a HC judge for contempt, the Vacation bench said, "The order was passed by the special bench. We cannot say anything…You ask these questions to the special bench."
Nedumpara sought a stay on the order as the judge faced imminent arrest. But the bench remarked, "Nothing has happened in the past one month. You wait for three or four more weeks and go to the special bench. We cannot help you."
