SC: Can't order establishment of Ram Rajya

The Supreme Court on Friday said that passing a judicial order has its limitations as it is not possible to establish Ram Rajya in the country or expect corruption to cease with a single directive.

The observation of the court came on a PIl seeking court’s intervention to rid public roads and footpaths from encroachments. The petitioner, one NGO Voice of India submitted that the problem of encroachment is spread across the country and only the Supreme Court can ensure rule of law to prevail.

The Bench of Chief Justice TS Thakur, Justices AM Khanwilkar and DY Chandrachud said, “We want to do various things but we cannot do. Our capacity to do things is limited. This is a problem…We can pass an order that there will be no corruption in the country and will all corruption goIJ. Should we pass an order that there will be ‘Ram Rajya’ in the country….It cannot be like this.”

The court was inclined to dismiss the PIl as it felt that the issue must point out specific encroachments in a State, which can be addressed by a particular High Court. But the petitioner NGO through its Chairman Dhanesh Ieshdhan said it was impossible for him to approach every High Court. The bench posted the matter for February next but asserted, “We cannot go by an assumption that everything in the country is wrong.”
