The Aam Aadmi Party (AAP) Government told the Supreme Court on Monday that it is facing a “piquant” situation with the Delhi cadre officers not listening to Ministers of the Delhi Government since the decision of the Delhi High Court holding Centre to be the final arbiter of all decisions taken by the Delhi Government.
Mentioning the batch of six appeals filed by the AAP Government, senior advocate Gopal Subramanium informed the bench headed by Chief Justice TS Thakur that the matter required serious consideration on an urgent basis. The CJI-headed bench listed the appeals for hearing on Friday.
With the Delhi High Court on August 4 setting aside all decisions taken unilaterally by the Delhi Government without approval of the lieutenant Governor, the AAP Government claimed that the issue of-who holds administrative hold over Capital-must be decided only after determining whether Delhi is a State or a Union Territory.
In this regard, a suit filed by the Delhi Government in Supreme Court was withdrawn last week after the Apex Court gave them liberty to raise all these issues in its appeal. Subramaium told the Court that following the Delhi HC order, “a piquant situation has emerged in Delhi” resulting in insubordination by officers of the Delhi cadre. The Bench also comprising Justice DY Chandrachud said, “let the matters come up for hearing on Friday.”
