National Herald case : Court summons papers from six Departments
Published on:

A Delhi court on Monday allowed the application of Subramanain Swamy seeking summoning of documents from the Central Government Departments in the National Herald case. The Government Ministries and Departments include Ministry of Finance, Income Tax Department, Urban Development and Corporate Affairs and Delhi Development Authority, Registrar of Companies.

Accepting the plea, Metropolitan Magistrate loveleen asked Swamy to follow the required procedure by providing the summoning fees for sending the summon to these Departments.

During the brief hearing, Swamy stated that he needs documents which these Ministries are supposed to provide in order to further take the case. “They (these Ministries and agencies) have the documents. I do not know what all documents they have. These documents can be summoned,” Swamy informed the court.

During the hearing, Swamy told the court that as per the court’s order, he has supplied the copies of the complaint and the annexures attached to it to the accused, who are refusing to accept it.

“They refused to accept it and are giving a blank statement that it was incomplete. I do not know what is incomplete. We have complied with the court's order and we are ready to give the documents to them if they will tell me what is incomplete,” Swamy said.

To this, the court said, “You send it to their offices through post.”

In his plea seeking summoning of documents, Swamy has said that they were required for the case. The documents which he has sought pertain to Associated Journal ltd (AJl) and its land allotment and ongoing investigation of Income Tax Department and Enforcement Directorate.

"Today, I got two favourable orders, one was that last time Mr. Sibal and the lawyers for the other accused wanted documents which I had submitted to the court to be given a copy of. Now, I did according to the order passed by the judge, I supplied all those documents which I had placed before the court. All the accused then refused to accept these documents, saying that in writing they have said that these documents are incomplete, so we will not accept," said Swamy to media.

"I told the judge, I don't know which document has not been submitted. They should have mentioned which document is missing. This looks like they are playing for time. So, the judge looked at it and said that he was also not able to comprehend what is it that they have not got, so, therefore, you send them a registered post and let that be taken as completion of the process. So that was one good favourable order," he added.

The court had on December 19, 2015, granted bail to Congress President Sonia Gandhi and her son Rahul Gandhi and three others — Motilal Vora, Oscar Fernandes and Suman Dubey — who had appeared before in pursuance to the summons issued earlier.

Sam Pitroda, another accused, was granted exemption from personal appearance for that day only on medical grounds. The next day of hearing is scheduled on on February 20, the next day of hearing.
