The Ministry of Home Affairs (MHA) has told Central Bureau of Investigation (CBI) that it will first examine the agency’s case diary and other relevant documents before giving permission to prosecute four Intelligence Bureau officials in the Ishrat Jahan fake encounter case.
Till then, the MHA has made it clear, it would not be able to give permission to CBI for any actions examine against the four IB officials, including its former Special Director Rajinder Kumar, and other officers P Mittal, MK Sinha and Rajiv Wankhede.
The CBI has been constantly seeking Government permission to initiate legal proceedings against the four IB officers for their alleged involvement in the fake encounter.
The case diary can only be shared with the court but the MHA is insisting on a copy of it to go into details of the case before granting any sanction. Sources said the CBI is consulting legal experts on whether the document can be shared with MHA.
