Kerala HC stays DNA test of Bitti for a week

Published on:

The Kerala High Court on Tuesday stayed for a week the order of a lower court in Kannur directing Bittihotra Mohanty, accused of raping a German woman in 2006 in Rajasthan, to undergo a DNA test which the police wanted to be done in order to confirm that he was Bitti himself and not Raghav Rajan of Andhra Pradesh as he was pretending to be.

Justice K Harilal of the High Court issued this interim order on a petition filed by Bitti, son of former Odisha DGP BB Mohanty, challenging the order of the session court in Thalassery, Kannur, permitting the police to subject him to DNA test to scientifically establish his identity.  Bitti still claims that he is Raghav Rajan.

Bitti had jumped parole in 2006 while he was serving a seven-year prison term in Alwar, Rajasthan for raping a 26-year-old German woman and had been absconding till his arrest by Kerala Police on March 9 in Kannur while he was working as a probationary officer with a nationalised bank under the identity of Raghav Rajan of Puttaparthy, Andhra Pradesh.

The Kerala Police claim that they had through investigations in Rajasthan where he was serving prison term, his native State Odisha and Andhra Pradesh had learned that he was Bitti himself but they have not got any scientific evidence to prove the identity. Even inquiries at the prison in Rajasthan had not yielded any conclusive evidence on this.
